1. General provisions

1.1. These Terms and Conditions govern the relationship between V E N Ltd, EIK 127624975, with registered seat and address of management at 153 Vladaysko Vastanie St., fl. 4, apt. 8, Shumen 9700, Bulgaria (the “Provider”, “we”), and any individual (the “User”, “you”) who uses the HouseTally mobile application (the “App”).

1.2. By registering and/or using the App, you accept these Terms and Conditions. If you do not agree with them, you should not use the App.

1.3. These Terms and Conditions should be read together with the Privacy Policy, which forms an integral part of them and describes the processing of your personal data.

2. Definitions

3. Description of the service

3.1. The App allows the User to capture receipts, which are converted into electronic form, and the data from them is extracted and classified into categories.

3.2. The App provides spending analytics, a personal archive of receipts, the ability to join into a household, a price map and shopping-list suggestions.

3.3. Data extraction is performed using automated tools, including artificial-intelligence tools. Recognition errors may occur; the User can correct the extracted data manually.

3.4. The Provider may develop, change, add or remove features of the App.

4. Registration and profile

4.1. Use of the App requires registration with a valid email address and a name or pseudonym.

4.2. The User is responsible for the confidentiality of their login credentials and for all actions taken through their profile.

4.3. The User undertakes to provide accurate information and to keep it up to date.

4.4. The App is intended for persons who have reached 18 years of age.

5. Households

5.1. Users may create or join a household via invitation and explicit acceptance.

5.2. Members of the same household can see the receipts and analytics of the other members. Before joining, the User is informed of this.

5.3. The User may leave a household at any time and manage the visibility of their receipts, including marking individual receipts as private/hidden.

5.4. The User undertakes to invite into a household only persons who agree to such sharing.

6. Community features and the common price base

6.1. Some features (such as the price map and optimised shopping lists) are based on a common base of price and item data, formed from the purchases of many Users in anonymised form.

6.2. To receive these features, the data from your purchases may take part in that common base in anonymised/aggregated form. You may withdraw your consent to that participation at any time in accordance with the Privacy Policy (section 13.1), in which case these community features become unavailable to you.

6.3. The Provider displays prices as aggregated/observed values, not as individual events linked to a specific User.

7. Anonymous aggregated data

7.1. The Provider may create anonymous aggregated statistics and reports based on the data in the App and provide or sell them to third parties. Only data from Users who have given their consent under section 6.2 is included; withdrawing that consent under the Privacy Policy (section 13.1) removes your data from these statistics and reports, including any provided or sold to third parties.

7.2. These reports contain only aggregated information and do not allow a specific User or household to be identified. The Provider does not provide third parties with raw records, images or individual data.

7.3. The processing of personal data for producing such anonymous reports is described in the Privacy Policy, including your right to object.

8. User rights and obligations

8.1. The User undertakes to use the App in good faith and in accordance with the law.

8.2. The User should not upload content unrelated to their own purchases, nor personal data of third parties without a lawful basis.

8.3. The User has no right to interfere with the operation of the App, to attempt unauthorised access, reverse engineering or mass data extraction.

8.4. The User is responsible for the accuracy of the information they enter manually.

9. Intellectual property

9.1. All rights in the App, its software, design, trademarks and content (except for data entered by the User) belong to the Provider or its licensors.

9.2. The User is granted a limited, non-exclusive, non-transferable licence to use the App for personal purposes in accordance with these Terms and Conditions.

10. Limitation of liability

10.1. The App is provided “as is” and “as available”. The Provider does not warrant that data extraction from receipts, categorisation or the prices shown are always accurate, complete and up to date.

10.2. The prices and suggestions shown are for information only and do not constitute an offer. The Provider is not liable for decisions made by the User on the basis of this information.

10.3. To the extent permitted by law, the Provider is not liable for indirect or consequential damages. Nothing in these terms limits liability that cannot be excluded by law, including consumer rights under applicable consumer-protection legislation.

10.4. The Provider is not liable for interruptions due to third-party providers, maintenance or force majeure.

11. Termination and deletion of profile

11.1. The User may at any time stop using the App and delete their profile from within the App.

11.2. Upon deletion of the profile, personal data is processed in accordance with the retention periods in the Privacy Policy. Anonymous aggregated data, which no longer constitutes personal data, may be retained.

11.3. The Provider may restrict or terminate a User's access in the event of a breach of these Terms and Conditions or of the law, where possible after notice.

12. Amendments to the Terms and Conditions

12.1. The Provider may amend these Terms and Conditions. For material changes, the User is notified through the App or by other appropriate means before they take effect.

12.2. Continued use of the App after the changes take effect is deemed acceptance of them. If the User does not agree, they may stop using the App.

13. Applicable law and disputes

13.1. These Terms and Conditions are governed by Bulgarian law.

13.2. Disputes are resolved by mutual agreement and, failing that, by the competent Bulgarian court, without prejudice to the User's mandatory rights as a consumer.

13.3. In the event of disputes, the User may also use the European Commission's online dispute resolution platform and may contact the Consumer Protection Commission.
